Terms of Service
These terms govern your use of Yesepy, the staff-budgeting platform available at yesepy.com and app.yesepy.com (the "Service"). The Service is operated by IP Jeksenbi (individual entrepreneur), Almaty, Republic of Kazakhstan ("Yesepy", "we", "us"). By creating an account you agree to these terms. Questions: info@yesepy.com.
1. The Service
Yesepy lets your team build and analyse staff budgets by position: headcount, salaries, bonuses, benefits, employer taxes, budget versions, and plan-vs-actual analytics. We may improve or change features over time; we will not remove core functionality you pay for without reasonable notice.
2. Accounts and workspaces
- You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
- A workspace owner controls who is invited into the workspace. Everyone invited can see the workspace's budgeting data – invite accordingly.
- You must be authorised by your company to enter its data into the Service, and you are responsible for having the right to enter it. You will indemnify us against third-party claims arising from data entered in breach of this.
- The Service is provided for business use only – it is not offered to consumers.
3. Plans, billing and the demo
- Plans are priced by headcount – the number of employees in a budget version – with a set number of team seats included per plan, as described on the pricing page.
- New accounts start with a free 7-day demo – the full product, capped at 15 employees and one budget version, with exports locked. No card is required for the demo. Upgrading to a paid plan lifts the caps on the same account.
- Payments are processed by Paddle, our merchant of record. Paddle handles checkout, invoicing, sales taxes and refund execution.
- Checkout purchases are additionally governed by the Paddle Buyer Terms.
- Subscriptions renew automatically (monthly or annually) until cancelled. You can cancel at any time; access continues to the end of the paid period.
4. Refund policy
- The free demo exists so you can evaluate the Service before paying.
- If the Service does not work as described, contact us within 14 days of your first payment and we will refund it in full.
- After that, payments for started billing periods are non-refundable, but you can cancel future renewals at any time. For annual plans cancelled mid-term, we refund the unused full months remaining after the current month, pro rata – write to info@yesepy.com and the refund is executed through Paddle.
5. Your data
Everything you enter into a workspace remains yours. We claim no ownership of it and use it only to provide the Service, as described in the Privacy Policy. For the workspace content you enter about your employees, your company acts as the data controller and Yesepy acts as a processor on your instructions. You can export your data at any time (Excel exports are built in) and request full deletion of your account and data. You are responsible for any data-residency or localisation rules that apply to the personal data you choose to enter.
6. Acceptable use
You agree not to: probe or breach the Service's security, access other customers' data, resell the Service without our agreement, use it to store unlawful content, or reverse-engineer it beyond what applicable law permits. We may suspend accounts that endanger the Service or other customers, and will tell you why.
7. Availability and support
We aim to keep the Service available around the clock, but it is provided "as is" without a general uptime guarantee; specific support or SLA commitments apply only where stated in your plan. We perform maintenance with as little disruption as we can, and back up customer data regularly.
8. Disclaimers
Yesepy produces budgeting estimates. Country tax presets are estimates for planning purposes, not legal or accounting advice – verify rates with a qualified local professional before relying on them for statutory filings or payroll execution.
9. Liability
To the maximum extent permitted by law, our total liability arising out of the Service – on any basis – is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential damages or loss of profits. Nothing in these terms excludes liability that cannot be excluded by applicable law, including liability for wilful misconduct.
10. Termination
You may stop using the Service and delete your account at any time. We may terminate accounts for material breach of these terms after notice, or immediately for serious abuse. On termination we delete workspace data as described in the Privacy Policy.
11. Governing law
These terms are governed by the laws of the Republic of Kazakhstan. Disputes that cannot be settled amicably are subject to the competent courts of Almaty, Kazakhstan.
12. Changes to these terms
If we make material changes, we will update the effective date above and notify account holders by email before the changes take effect. Continued use after that constitutes acceptance.
